| Court Makes Ruling On Airport |

In a unanimous decision, the court ruled that the Blue Grass Airport can not be held liable for the 2006 crash. The court says, because the airport is a government entity, it has sovereign immunity. Flight 5191 went down shortly after takeoff from the Blue Grass Airport, killing 49 people in August 2006. Comair sued, saying the airport should also be held legally responsible for the crash as well. The Supreme Court also made another ruling today involving the Comair crash. In another unanimous decision, the court recognized what is known as the spousal loss of consortium. After the Comair crash, spouses of some of the victims began pushing for Kentucky to recognize spousal loss of consortium in wrongful death cases. Prior to today's decision, a husband or wife could only recover damages if their spouse was injured, not killed. This decision is not retroactive, so it would not apply to those who lost a spouse in the crash. Trackback ( 0 )
